Today’s investigators navigate AI-generated videos, disappearing posts, encrypted chats, and ever-changing privacy rules. Social media investigations and internet mining remain at the core of modern claims work, but how those tools are used and what they reveal has changed dramatically.

Social Media Investigations in 2025

Social media investigations remain a cornerstone of modern digital claims work. These investigations gather evidence from a claimant’s online presence across Facebook, X, Instagram, TikTok, YouTube, LinkedIn, and other platforms.

In 2025, more than 85% of insurers conduct or outsource social media investigations as part of their fraud detection programs. The goal is to identify lifestyle contradiction through posts, reactions, or tagged photos that conflict with a reported injury or limitation.

In 2024, a Florida claimant receiving disability benefits posted TikTok videos of competitive CrossFit training. The insurer saved an estimated $68,000 in improper payouts after verification.

Internet Mining in 2025

  • TAKE IT DOWN Act (2025): Enacted in May 2025, this law criminalizes the distribution of AI-generated or non-consensual intimate imagery and requires online platforms to remove such material within 48 hours of verified notice. Although designed to protect personal privacy, it also establishes precedent for platform liability in hosting manipulated media.
  • FTC & DOJ AI Guidance (2024): Federal regulators issued joint statements emphasizing “truth-in-AI” standards, warning that AI-manipulated materials used in fraud, marketing, or claims falsification may trigger enforcement under existing unfair practices laws.

At the state level, synthetic media laws are expanding:

  • California AB 2655 (2024): Broadens the definition of “deepfake” under privacy law and grants civil remedies to victims of AI-generated deceptive content.
  • Minnesota SF 3564 (2024): Establishes penalties for distributing AI-generated false evidence that results in financial harm.
